TV channel turns hijab controversy discussion into anti-Muslim tirade

Date: 16 July 2020

Category: Hate speech

In a channel segment called India Upfront, TV channel Times Now alleged that a Hindu student of Aligarh Muslim University, who was allegedly harrassed for her comments on hijab, was being targeted because she stood up in support of Citizenship Amendment Bill. However, the mother of the complainant clarified that this was not the case.“The issue has been politicised and the media should not have linked it to the CAA,” the mother of the student said. The program was carried with the captions ‘complainant alleges she was harassed for supporting CAA NRC’, ‘student opposes Shaheen Bagh’ , ‘#AMUHijabUltimatum’ and ‘Islamists hijacking University?’. One of the panelists, author Anand Ranganathan, alleged that “extremism and fundamentalism at AMU has been supported and cushioned by those who belong to the same religious or intellectual ideology. What if a Muslim tomorrow says ‘those who disbelieve in our verses, we will drive them into a fire’?” while BJP spokesperson Sudhanshu Trivedi commented that the university had become “the epicentre of Pakistan and 1st Pak PM”. The girl, who is an engineering student at AMU, had alleged that women in AMU hostels were being forced to wear hijab. However, she could not clarify which hostel it was, and other students soon pointed out that this was not the case. Meanwhile, a reply to her comment, which suggested that she would be put in a ‘brass hijab’ after the lockdown, kicked up a controversy. The architecture student who made the comment later stated that he was being sarcastic and had not meant to use the word ‘brass’.

Hindus and Muslims selling property to each other ‘not okay’, says Gujarat CM

Date: 27 July 2019

Category: Discrimination

While commenting on the Gujarat’s problematic ‘Disturbed Areas Act’, which was amended in July 2019, Gujarat Chief Minister Vijay Rupani said that “a Hindu selling property to a Muslim is not okay. A Muslim selling property to a Hindu is also not okay” and added that “we have set this rule in areas where there have been riots to tell them (Muslims) that they must buy property in their own areas.” The law has been accused of being weaponized  to disincentive property transactions with Muslims, causing spatial segregation on religious lines.  According to a report in The Caravan, generally, when property sellers approach the collectors for carrying out transactions with Muslim buyers, , “the permission is denied or the applications are kept pending for months or even over a year.” An official at a sub-registrar office in Ahmedabad confirmed to the publication that “most cases of pending or delay in approvals are when the buyer happens to be a Muslim.” This has caused a large number of Muslim families to remain trapped in backward areas where there are no facilities like good schools. Some of these areas, like Shahpur, have not seen any violence since the 2002 pogrom, but continue to be listed as ‘disturbed’. The state’s right-wing leaders have been vocal in their demand for Hindu-Muslim segregation in Gujarat, which comprises instilling a sense of paranoia about Muslims taking over land belonging to Hindus. They propagate an inaccurate interpretation of the Disturbed Areas Act—that spatial segregation on religious lines would ensure that there are no riots. Gujarat is the only state with such restrictions on the transfer of properties. In the last three decades, the state government does not seem to have studied the impact of the Act. None of the demarcated disturbed areas have ever been delisted. Instead, the state government brought in 74 new locations under the Act.Experts have pointed out that the Act is a violation of fundamental rights.

Journalism student denied position at media portal because she wore hijab

Ghazala Ahmad, a 24-year-old final year student of Mass Communication at Aligarh Muslim University was told that she could not be accepted as an anchor at a Delhi based Hindi Media Channel because she wore Hijab. After clearing the initial selection process over a telephonic interview and while some formalities such as the salary and the starting date were being discussed, she informed the interviewer that she wore a hijab and inquired if that would be a problem. She was told that she would have to remove her Hijab, the headscarf that Muslims wear to cover their head, or else she would not get the job. “The line went silent for a couple of minutes”, she said, “and I kept asking if someone was still there or not. After about three minutes, he said aap samajh nahin rahin hain. Badhe badhe channels nahin rakhte. Hamara to chhota sa portal hai [You’re not understanding. Even big media channels do not hire (hijabis). We are only a small portal)] .” “He told me that this is India and no broadcaster has ever had a Hijab-wearing person. He told me to understand his situation because if he recruits anyone with a Hijab, his channel would be shut down. He asked me to try writing for a paper instead,” she said.

Delhi violence: Rioters openly declare that they killed Muslims

Date: 4 March 2020

Category: Hate violence

In an investigative report published by the news portal Scroll.in, members of Hindutva mobs openly admitted that they had murdered Muslims in the violence that broke out in northeast Delhi in February 2020. One of the killers, Nishant Kumar, described it as an act of “retaliation”, although none of his property had been destroyed. “The Mohammadan was running,” he recalled. “The Hindu public was chasing him. I was leading the pack. I was the first to catch up with him, and hit him with my rod on his head,” he continued, “then he fell down, and the public pounced on him after that…de dhana dhan dhan.” Kumar said he killed two more people in a similar fashion – striking Muslim men running away from Hindu mobs in the back with his improvised weapon. “I had to kill three. I did that.” The driver claimed the security personnel stationed in the area actively supported his group. “They said: you give us the weapons, we will give you dead bodies,” he said. “Their bullets are accounted for, so they can’t fire from their weapons. For us getting guns is no big deal. All our friends are from Etawah, Agra, Haryana where guns abound.” Another man, a cab driver, went to the Muslim-majority neighbourhood of Chandbagh, armed with a sword and a gun. “We knew, of course, which houses belonged to Muslims,” he said. After cutting off the electricity, the driver said the Hindu men went on a killing spree. “Saalon ki ginti kam kar di – humaare dil me tassalli hai humnein joh haath se karaa,” he said. “We reduced their numbers – there is great satisfaction about what we did with our hands.” The bodies, he claimed, were dumped in a sewage canal that runs through the area.

Assam assembly passes bill to abolish state-run madrasas

Date: 31 December 2020

Category: Discrimination

The Assam assembly on December 30 passed the bill to abolish all state-run Madrassas and convert them into regular educational institutes with effect from April 1, 2021, amid protests by the Opposition parties. Opposition parties Congress and All India United Democratic Front had sought the Bill to be sent to the Assembly’s Select Committee for a proper discussion on it. However, Speaker Hitendra Nath Goswami rejected the demand and placed the Bill for a voice vote. Later, it was passed. The members of the state’s ruling coalition such as BJP, Asom Gana Parishad and Bodoland People’s Front voted in its favour. Education Minister Himanta Biswa Sarma said the Assam Repealing Bill, 2020 would repeal the Assam Madrassa Education (Provincialization) Act, 1995 and the Assam Madrassa Education (Provincialization of Services of Employees and Re-Organisation of Madrassa Educational Institutions) Act, 2018. He said the madrasa institutes would now be converted into upper primary, high and higher secondary schools with no change of status and pay, allowances and service conditions of their teaching and non-teaching staff. Sarma said 97 state-run Sanskrit tolls (Sanskrit-learning centres) would also be converted into study centres, research centres and institutions to study certificate/diploma/degree courses under the Kumar Bhaskar Varma Sanskrit and Ancient Studies University. In February this year, the government had said: “Religious teachings cannot be imparted with government funds in a secular country”.

Hours later, he was expelled, with the party claiming that they had not known who he was. After the shooting, BJP had claimed that Gujjar was an AAP member. However, his father later gave a statement that his son was a “supporter” of Narendra Modi and Amit Shah, although he was not associated with any party at the time.

BJP MPs oppose move to name Bengaluru roads after Muslims figures

Date: 31 December 2020

Category: Hate violence: Verbal

BJP Bangalore South MP Tejasvi Surya, along with MP from Uttara Kannada Ananth Kumar Hegde on 31 December wrote to civic commissioner Manjunath Prasad, opposing naming of roads after Muslim figures in a minority-dominated area in Bangalore. Tejasvi Surya in his letter described the move to name a few roads after Muslims in Padarayanapura, Bruhat Bengaluru Mahanagara Palike (BBMP) Ward no 135, as reeking of “communal mentality of two nation theory”, and requested the BBMP commissioner to revise the list with non-Muslim public figures. Tejasvi Surya in the letter said, “Christening of roads in Muslim-dominated locality with only Muslim names reeks of the same communal mentality of the two-nation theory and Muslim League’s demand of separate electorates for Hindus and Muslims. This is dangerous and must be condemned.” Ananth Kumar Hegde, meanwhile, wrote to the BBMP Commissioner, saying this was promotion of one particular community. “Only names of Muslim leaders have been recommended in this particular ward. It is not appropriate to undertake such a step in the name of social work, which is nothing but the promotion of one particular community.” The row came as a stark reminder of the controversy surrounding the 100-ft wide road at Indiranagar in the city when the BBMP decided to name it after renowned folklorist Dr S K Karim Khan in 2014. The BJP insisted that the road be named after former Prime Minister Atal Bihari Vajpayee, though the municipal corporation had passed a resolution in 2006 to name it after Dr Khan, who had a vast collection of oral epics and ballads. Due to the intervention of a pro-Kannada organisation, the road was finally named after Khan. Moreover, other BJP-ruled states such as Uttar Pradesh have been on a renaming spree, changing Muslim-sounding names to Hindu ones, and have been making demands such as the renaming of Hyderabad to Bhagyanagar.

TV channel says Tablighi Jamaat members are ‘corona bombs’

Date: 2 April 2020

Category: hate speech

The Hindi news channel ABP News coined the term ‘corona bombs’ to describe the people who had attended the Tablighi Jamaat congregation in Nizamuddin and then travelled to different parts of the country. Telecasting a series of images of bearded men in skull caps to the accompaniment of thumping background music, the channel attempted to create an atmosphere of terror around these members in its coverage through the show ‘Master Stroke’. It also used problematic words like ‘spread’ to describe the movement of Jamaat members. ‘Ye woh log hai jo dilli ke Nizamuddin se nikalkar desh ke alag alag shehron main phehl chuke hai’ (these are the people who came out of Delhi’s Nizamuddin and have ‘spread’ to different cities in the country). The channel gave numbers on the rising cases in the country linked to Tablighi Jamaat,, but failed to mention that this might be because more people associated with the Jamaat were tracked and tested by the government than any other hotspot. The show also displayed a map laying out the number of Jamaat members who had travelled to each state and the number of infected people among them. In the days that followed India media’s obsessive coverage of the Tablighi Jamaat congregation, several Muslims- connected to the Jamaat and otherwise- were attacked by locals or boycotted due to fear of being Covid-19 carriers.

Christian preacher spews Islamohobic venom in sermon

Date: 3 September 2020

Category: Hate Speech

Father Xavier Khan Vattayil, a Christian priest based in Kerala, alleged in a sermon that there was a ‘Christian genocide’ happening in the state and a section of the society was displaying ‘extremist’ behaviour. “Even when an atmosphere of peace and brotherhood remains, a section of the society is displaying extremist tendencies. People who wish to kill and destroy are gaining strength in Kerala. And they are fast growing. Not just in political parties, these extremist jihadists can be seen among journalists and writers as well,” he said.He also alleged that conspiracies were being hatched to eliminate the Christian population in the state and terrorism was taking deep roots. Pointing to Islamic preacher Dr Zakir Naik’s request to Muslims to travel to Kerala, the priest pointed out that if people from other parts settled in Kerala, it would lead to an imbalance in the demography. He also made a reference to Sweden, alleging that they had welcomed refugees with good intentions but then that resulted in riots. They might be a minority, he said, but 10 or 15 people were enough to create a bad name for the entire community, he said.

Muslims in Meerut put up ‘for sale’ signs, flee village

Date: 1 January 2021

Close to 40 Muslims families in Mavi Meera village falling under Daurala police station in Meerut district of Uttar Pradesh fled the village after putting up ‘for sale’ signs outside their houses. They were reportedly facing harassment from Gujjars, a local Hindu community in the village. According to one villager, the Gujjars harass Muslims in the village for trivial matters and the police, instead of filing charges, try to settle matters through talks. Recently, a Gujjar youth from the village did some shopping worth Rs. 20 from a Muslim shopkeeper of the village. However, he did not pay. There was a fight between the two sides over it when the Muslim shopkeeper insisted on his money. Shamshad alleged that “Gujjars broke into the house of the Muslim shopkeeper and opened fire. However, the administration has not shown any seriousness in the matter”. The Muslims of the village say that they have complained about this from the district to the state level but to no avail, so they have decided to flee the village. Another villager Mohammad Sharif told India Tomorrow, “In Meerut, we tried to register our complaints with the police at three places. However, not a single case was registered in the police station. Every time the police refuse to file cases saying these kinds of petty incidents keep happening in the village. However, bullets have also been fired in the village by Gujjars”. Police, however, claimed that there was no communal problem and it was only a mild clash.

MP authorities demolish close to 80 Muslim houses after violence breaks out

Date: 31 December 2020

Category: Hate violence

Amidst the prevailing communal tensions triggered by the rallies of right-wing groups at multiple places in Madhya Pradesh, Municipality officials accompanied by police came with bulldozers and demolished the homes of poor Muslims in Chandankhedi village of Indore district. According to the locals, the village is under the presence of heavy police which have installed barricades at different entry points to restrict the movement of the public. The demolition of houses came a day after the area witnessed clashes between Muslims and Hindus who were part of a rally that marched through the village and raised “provocative slogans” outside a mosque. “Our locality is fully Muslim and there are no Hindu households here, still they came to provoke us,” said another Muslim resident. Videos circulating on WhatsApp show a crowd of Hindu men singing hymns in front of the mosque and blocking the road for movement. Some Muslims raised objections and started arguing which eventually led to violent clashes. Following clashes, hundreds of policemen swooped in on the locality and rounded up a number of Muslim men and boys. Some of them were reportedly booked under the National Security Act. The police action has triggered a dread among the Muslims who say they do not spend their nights at their homes due to fear of raids. “Policemen come, search our houses and whoever they find, they nab them,” said another Muslim resident. “From my locality at least 12 people have been arrested so far but they are targeting many more.” The officials argue that the demolition is part of an anti-encroachment drive to clear the road of illegal structures. But Muslims say that the drive is “lopsided”. A local resident said that a lady who lived on rent in the house owned by a  Hindu had thrown a stone during the clashes. “When the officials started to demolish the house and they found it belonged to a Hindu, they stopped and moved to next house of a Muslim and brought it down completely,” he said. “The woman, however, was arrested and charged with attempt to murder.” Indore District Congress President Satish Yadav asked why the authorities chose to carry out demolition in the violence-affected area. “We strongly object to the timing of the administration’s removal drive for so-called road widening work,” he was quoted as saying.

Madhya Pradesh violence: Hindutva leader puts out hate-filled video

Date: 31 December 2020

Category: Hate speech

In the aftermath of violence that broke out in Ujjain following a Ram Mandir rally, right-wing Hindutva leader Acharya Shekhar put out a video warning Muslims to refrain from creating a “disturbing environment”. “We will create so many graveyards in Madhya Pradesh that you will struggle for space to bury your dead,” he says in the two-minute video. He claimed that he was responding to reports of the “challenge of a Muslim cleric” Khaliq ur Rehman who had appealed to the police officials that they should stop action against Muslims or the situation would go out of hand  in 15 minutes. He asks the administration to “give up eating sewaiyan (vermicelli) of Muslims and stop being their slaves and focus on their duty”. Shekhar boasts about the 25 lakh-strong Hindu population of Ujjain district and asks the administration to demolish properties to evict those Muslims who have given “threats at the behest of Owaisi”– purportedly referring to AIMIM leader Assaduddin Owaisi.

BJP criticizes Shiv Sena over Urdu calendar

Date: 1 January 2021

Category: Hate speech

An Urdu calendar published by the youth wing of Shiv Sena came under fire from BJP, which accused the party of trying to “appease Muslims”. The calendar, published by the Wadala branch of Shiv Sena's youth wing Yuva Sena, refers to Balasaheb Thackeray as 'Janab' Balasaheb Thackeray. BJP MLA and Spokesperson Atul Bhatkhalkar said that Shiv Sena might have failed to rename Aurangabad as Sambhajinagar, as proposed by Balasaheb Thackeray, but it has managed to rechristened Hindu Hriday Samrat Balasaheb Thackeray as Janab Balasaheb Thackeray. "The Urdu calendar mentions Muslim festivals, Muslim sun rise, moon rise; and not just that, it also refers to "Chhatrapati Shivaji Maharaj Jayanti" (birth anniversary) in a singular manner by just calling it "Shivaji Jayanti". We strongly condemn this. The Shiv Sena is doing this for votes," the leader said.

Republic TV accuses Congress of publishing ‘Muslims only’ manifesto

Date: 27 November 2019

Category: Hate speech

News channel Republic TV accused the Congress of coming out with a ‘Muslims only’ manifesto for the Telengana elections, promoting their discussions with the hashtag “#CongressforMuslims. The segment ‘The Debate’ stated that the Congress promised hospitals exclusively for Muslims and free power supplies to mosques. “The Congress has been on an appeasement overdrive in Telangana … 11 Muslim-only schemes have been promised,” says the voiceover. Editor-in-chief Arnab Goswami, who ran the debate, alleged that free electricity was not being given to Hindu temples. Goswami added: “They say that Rs5 lakh will be given only to Muslims for house construction … which means ghar banane ke liye … Hinduon ko, Sikhon ko ghar banane ke liye loan bhi nahin milega… (Hindus and Sikhs won’t even get loans to build houses)”. Goswami throughout the debate emphasised how there was nothing for Hindus in the manifesto and that all benefits—scholarships, funds, healthcare and so on—would be accrued by Muslims. However, an analysis of the manifesto showed that the party had offered similar opportunities and schemes to other categories as well- namely, the SC, ST, OBC and EBC (economically backward sections, which include Brahmins, Reddys, Vaishyas, Kammas and Velmas as well).

TV Channel wrongly claims Congress manifesto is ‘Muslims only’

Date: 26 November 2018

Category: Hate speech

After the Indian National Congress released its manifesto for the Telengana assembly elections, news channel Times Now alleged that the manifesto benefitted ‘Muslims only’. Times Now editor-in-chief Rahul Shivshankar ran a debate on November 26 based on the “rank favouritism” of the manifesto’s draft copy. Headlined “Shock assault on secularism”, Shivshankar said the manifesto’s promises “might even be illegal”, since the Congress was promising seven “Muslim-only” schemes, where “taxpayer money will be used to benefit one religion, more so perhaps than even others”. However, an analysis of the manifesto showed that the party had offered opportunities and schemes to other categories as well- namely, the SC, ST, OBC and EBC (economically backward sections, which include Brahmins, Reddys, Vaishyas, Kammas and Velmas as well).

Zee News fined for calling poet Gauhar Raza ‘anti-national’

Date: 2 September 2017

Category: Hate speech

The News Broadcasting Standards Authority asked Hindi news channel Zee News to apologise on air for calling poet, scientist and filmmaker Gauhar Raza a member of the “Afzal Premi Gang” in March 2016. The NBSA also asked the media house to pay a fine of Rs 1 lakh. The agency asked the news channel to air the corrigendum on September 8, and to remove the footage of the programme from its websites. In its reportage between March 9, 2016, and March 12, 2016, Zee News had repeatedly telecast a clip of Raza reciting three of his poems at an annual poetry event named Shankar-Shad Mushaira. The poems were about theatre activist Safdar Hashmir and the murder of two journalists in Iraq in 2010. Zee News ran the clip in a show titled “Afzal Premi Gang ka Mushaira”. The clip was played along with footage of protests that took place at the Jawaharlal Nehru University in February 2016. Raza had said Zee News had branded him as anti-national and a supporter of the 2001 Parliament attack convict, Afzal Guru. The NBSA has said that it was “highly inappropriate and derogatory” of Zee News to call the programme “Afzal Premi Gang ka Mushaira”. “The broadcaster had failed to give an opportunity to Professor Gauhar Raza, who was being reported upon, to give his version/views,” it said in its order.

SC sets aside Kerala HC order annulling interfaith marriage

Date: 8 March 2018

Category: Discrimination

The Supreme Court in a landmark order restored the marriage of 26-year-old Hadiya and set aside the May 2017 Kerala high court order that had annulled her marriage with a Muslim man named Shafin Jahan. Born a Hindu, Akhila became known as Hadiya after converting to Islam. When she later married Jahan, her decision set off cries of religious conversion by the Hindu Right which termed it as ‘love jihad‘. In its ruling, the Supreme Court also said that the Kerala high court should not have annulled the marriage in the first place. During the hearing, the Supreme Court bench reiterated that the court cannot intervene in the case of a marriage between two consenting adults. In addition to annulling the marriage, the Kerala high court had said that Hadiya was to be in the custody of her parents (who opposed her conversion and choice of partner). This move was widely criticised by women’s rights groups and activists, given that Hadiya is an adult woman and should not have to be in anyone’s ‘custody’. The high court had made several controversial statements such as, “a girl aged 24 years is weak and vulnerable, capable of being exploited in many ways” and “her marriage being the most important decision in her life, can also be taken only with the active involvement of her parents”. The National Investigative Agency had said previously that Hadiya and Jahan’s marriage could be classified as a case of ‘love jihad’. However, the agency had not offered any proof on this, and Hadiya had maintained that she converted to Islam and then later married Jahan of her own volition.

Zee News raises bogey of ‘love jihad’, uses skewed examples

Date: 23 October 2017

Category: Hate speech

In a show hosted by editor-in-chief Sudhir Chaudhary on 23 October, Zee News presented a “report” about ‘love jihad’ conspiracies in India, particularly Kerala. The show starts with a statement put out to “parents worried about the safety and future of their children”- “Our intention is not to worry you, but to warn you”.  It was aired with the image of a girl in ‘bindi’ wearing a niqab, with the bindi streaming down to resemble blood. The show presented testimonies from several Hindu girls as “evidence”, but failed to put forth some crucial questions. One of the girls mentioned in the story converted to Islam and then re-converted to Hinduism claiming she had made a mistake. However, there was no romantic relationship involved, and the anchor fails to mention where the “love jihad” scare comes from. Another unnamed girl spoke about the “love jihad’’ technique adopted by Muslims. “First they flirt with you, “as in films”, then they propose, and eventually, “feeling  sympathy, you accept,” she said. However, the channel does not ask what happens after that, again failing to establish any concrete proof of ‘love jihad’. The third story was a diary entry written by a girl who had later gone missing, which again provides no real proof of anyone having coerced her into conversion through fake relationships. At the end of the show, the anchor gives out a warning- “Unimaginable scenes will be seen on Kerala’s streets. Be alert, because the syndicate carrying out conversions in the name of love jihad may well become active in your neighbourhood too. It is our responsibility to warn you. Discuss this with your children too.” In October 2018, the National Investigative Agency conducted an investigation into ‘love jihad’ allegations in Kerala and found the theory to be baseless.

Republic TV anchor screams at Muslim panelist to chant ‘Bharat Mata ki Jai’

Date: 12 March 2019

Category: Hate speech

In a primetime debate aired on 12 March with the hashtag #CongBharatMataClaim, Republic TV editor-in-chief and anchor Arnab Goswami screamed at paneslist Faheem Baig to chant ‘Bharat Mata ki Jai’. A complaint was subsequently lodged by a viewer to the News Broadcasting Standards Authority. The complaint noted that Goswami “pilloried Shri Karim Baig, Muslim participant in the debate, to say ‘Bharat Mata Ki Jai’ implying that he was not a patriot if he did not say that on the program”. He also argued that the programme violated the NBSA’s guidelines on reporting that state that “racial and religious stereotyping should be avoided” and that “caution should be exercised in reporting content which denigrates or is likely to offend the sensitivities of any racial or religious group or that may create religious intolerance or disharmony”. The NBSA asked the channel to air an apology, but it did not comply.

India Today edits interviews, produces ‘big expose’ of Islamic organization

Date: 31 October 2017

Category: Hate speech

News channel India Today conducted a ‘sting’ operation on Satya Sarani, an institute run by the Islamic organization Popular Front of India, claiming that the channel had “lifted the veil off the non-profit, securing stunning confessions of its top functionaries about its mass proselytizing, illegal financing and about its ultimate goal to turn India into a theocratic Islamic state”. The sting was conducted on Sainaba, president of the women’s wing of the organization. Sainaba is purportedly heard saying those who go to Satya Sarani move out “only after embracing Islam”, implying forced conversions. Sainaba accused the channel of “editing a long conversation for fabricating evidence against Popular Front of India”. “It happened about one month back,” she said in a statement, referring to her conversation with the undercover reporters. “It lasted for one-and-a-half hours. But the questions and answers were edited intentionally to hunt me.” Popular Front of India leader Sainaba and its institute Sathya Sarini played a big role in the life of Hadiya, whose marriage to a Muslim man was infamously annulled by the Kerala High Court, but after her formal conversion. There is no ambiguity in Sathya Sarani’s website about its ultimate goal, which includes “Propagation of Islam among non-Muslims.’’ The website also says the institute provides a “safe facility for those who want to study Islam”. On its part, the channel could present no one who claimed to have been forcibly confined at Sathya Sarani, let alone forcibly converted. While the anchor said that “scores of men and women are churned out” of this “conversion factory”, the visuals showed empty classrooms and only a few men around. The reporter managed to talk to a few converts there, who seemed quite at ease telling him when they had converted and what their names were before conversion.  The institute’s activities were described as a “well-oiled racket for conversions”, but the sting could not prove that these were forced. Whatever was telecast was in sync with the information available on Sathya Sarini’s website. Just a few weeks before the sting, three women had filed police complaints about being forcibly detained and assaulted at a “reconversion” centre called Sivasakti Yogavidya Kendram in Kerala. One woman even complained that she had to marry a Hindu to get out of the place. But not a word of this was breathed during the Sathya Sarani sting, or any time during the Hadiya debate.

UP woman married Muslim man after introducing him as Hindu, husband arrested

Date: 2 January 2021

Category: Discrimination

The husband of a teacher and civil service aspirant from UP’s Kannauj, who married a Muslim man after introducing him as a Hindu to her family, was arrested under UP ‘love jihad’ law. The woman insists that she had known he was Muslim, but had hidden his identity because she was sure her family would not approve of her marriage to a Muslim man. Priya Verma, 29, had married Taufiq (32), her boyfriend of two years and a fellow civil service aspirant, with Hindu rituals, in the presence of her parents a month ago. But now they are apart — Taufiq is in jail under the Uttar Pradesh anti-conversion law, and she is at home, trying to resist her parents’ attempts to get her married again. She insists she wasn’t misled. Priya says she had known his real identity when they got married at Lucknow on 10 December, that he never tried to convert her, and that he was ready to adopt Hinduism.  But her family got to know about Taufiq’s real identity just two days after their marriage. A local BJP leader got involved and convinced Shukla that it was a case of “love jihad”. He told him that a police complaint should be filed in the matter.  She was subsequently made to stay back at her parents’, and Taufiq put behind bars under sections of impersonation, cheating, marrying with fraudulent intention, malicious act intended to outrage religious feelings and sections 3 and 6 of the Uttar Pradesh Prohibition Of Unlawful Conversion Of Religion Ordinance, 2020. Notably, the complaint on which the FIR is based says nothing of conversion.

Kerala HC denies anticipatory bail to mother of man charged of triple talaq

Date: 2 January 2021

Category: Discrimination

The Supreme Court set aside a decision by the Kerala high court to deny anticipatory bail to the mother of a man who was charged under the ‘triple talaq’ law. The offence under the triple talaq law can only be committed by a Muslim man, and his mother cannot be accused of it, the Supreme Court has ruled while granting anticipatory bail to a woman named Rahna Jalal from Kerala. “...on a preliminary analysis, it is clear that the appellant as the mother-in-law of the second respondent cannot be accused of the offence of pronouncement of triple talaq under the Act as the offence can only be committed by a Muslim man,” the bench said in its December 17 judgment. The court also held that there was no bar on anticipatory bail under the Act provided the substantive conditions in Section 7(c) are met. These conditions are that the court must first hear the married Muslim woman who has made the complaint and must be satisfied that there are reasonable grounds for granting bail to such person. Jalal’s daughter-in-law had lodged an FIR at the North Parur Police Station complaining of offences under Section 498-A (cruelty by husband or relative of husband) of the IPC and The Muslim Women (Protection of Rights on Marriage) Act, 2019. Though Kerala opposed the anticipatory bail prayer, citing Section 498-A IPC, the court said “having regard to the vague and general nature of those allegations in the FIR, bereft of details, the appellant… should not be denied the benefit of the grant of anticipatory bail”.

MP CM calls for law against stone pelters

Date: 3 January 2021

Category: Hate violence, discrimination

Madhya Pradesh government will bring a stringent law against stone pelters, which will have a provision to auction their assets to repay for any damage caused to a public property or an individual, Chief Minister Shivraj Singh Chouhan said. His statement comes in the wake of recent incidents of stone pelting on vehicle rallies taken out in western Madhya Pradesh by some groups to raise awareness about the construction of Ram temple in Ayodhya. Right wing organisations, including the Vishva Hindu Parishad (VHP), have said that stones were hurled at them during the rallies. However, Muslims in the Malwa region (western region) have alleged that their places of worship and houses were targeted during the rallies. Cops and other authorities have also razed down Muslim-owned buildings from where stones were allegedly thrown at rally members. Addressing media persons in Bhopal, the CM said that “stone pelters are enemies of the society”. He said stone pelting is no ordinary crime as it could result in deaths, spread terror and chaos and disrupt law and order. He said stone pelting apart, such offenders often resort to damaging public property and arson, even burning down homes and shops. “While people have a right to raise their issues peacefully in a democracy, no one has the liberty to damage public property,” the CM said.

Muslim comedian beaten up for “insulting” Hindu dieties, arrested

Date: 3 January 2021

Category: Discrimination, hate violence

Popular stand-up comedian Munawar Faruqui and four others were arrested after the son of a BJP MLA filed a complaint against them for allegedly 'outraging religious feelings'. They were allegedly beaten up by a Hindutva mob before arrest, but no action has been taken against the mob. In his complaint, Eklavya Singh Gaur, son of local BJP MLA Malini Laxman Singh Gaur, accused Munawar Faruqui and 4 others of making ‘indecent' remarks about Hindu deities as well as Amit Shah during a show. “The show mocked Hindu deities by passing indecent comments. The Godhra incident and Union Home Minister Amit Shah were also mentioned inappropriately,” the complaint said.  A local court rejected their bail pleas and sent them to judicial custody. They were booked under sections 295-A (outraging religious feelings), 269 (unlawful or negligent act likely to spread the infection of any disease dangerous to life), and other provisions. However, Indore Police later said they had no video evidence to show that comedian Munawar Faruqui insulted Hindu deities during a performance at a cafe in the city, The Indian Express reported. Kamlesh Sharma, the town inspector of Tukaganj Police Station, told the newspaper that the video submitted by the complainant showed another comedian making jokes about the deity Ganesh. “There’s no evidence against him [Faruqui] for insulting Hindu deities or Union Minister Amit Shah,” Sharma said. An audience member also took to Instagram to deny that any such comments had been made. Meanwhile, SP Vijay Khatri told the website Article 14 that “it did not really matter” if Faruqui did not make the comments during the show and it was enough that they had an “intent” to do so. He also praised the goons for being “active and alert”.

Woman tries to frame three Muslim men under false ‘love jihad’ allegations

Date: 3 January 2021

Category: Discrimination

A 22-year-old married woman in Uttar Pradesh’s Bareilly allegedly filed a “fake” complaint against three Muslim men, all in their 20s, under the new anti-conversion ordinance, claiming they were “stalking and sexually harassing” her and were “forcing her to convert and marry one of them.” According to the police, the woman’s allegations against the three Muslim youths, who are relatives, pertained to a particular incident that occurred on December 1. However, inquiries revealed that the three were “incorrectly framed” as they were out in Bareilly that day. The police would now reportedly submit against the complaint a report under Section 182 (false information with the intent to cause a public servant to his lawful power to the injury of another person) of the Indian Penal Code, Bareilly senior superintendent of police (SSP), Rohit Singh Sajwan, said. However, the FIR against the three men has still not been expunged, according to a report in The Hindu. Police said the woman, before her marriage, had an affair with one of the three youths. In September last year, she eloped with him, following which her uncle lodged a missing complaint with the police. She was found within nine days. Her family later married her off to a man belonging to their community. The woman, in her “false” complaint, had accused the youth of stalking and harassing her after her marriage. She claimed that on December 1, he asked to convert and marry him after stopping her at gunpoint. Later, his two cousins threatened her family members with murder, she said.
