78 out of 86 cases under ‘love jihad’ ordinance against Muslims

Date:  9 JAnuary 2021

Category: Discrimination

An affidavit submitted at the Allahabad high court by the UP government shows that out of the 86 cases booked under the UP Prohibition of Unlawful Conversion of Religion Ordinance, 2020, which was passed in November, 78 are against Muslims, while 7 people have been named for alleged efforts to convert people to Christianity. These statistics are part of the state government’s affidavit presented before a high court bench led by chief justice Govind Mathur on Thursday, in response to a batch of public interest litigations (PILs) that claimed the law violated several constitutional rights. The Uttar Pradesh government has told the Allahabad high court that its contentious new anti-conversion ordinance didn’t target any particular religion and was equally applicable to all forms of forced conversion, not just interfaith marriages. But a scrutiny of the statistics submitted by the Yogi Adityanath government in court presents an intriguing picture. Family members of those booked by the police have alleged that the police have slapped fake charges against them, but the administration insists that is not the case. In one case, 26 family members of a Muslim man, which included five women, were booked in Etah for allegedly forcing a 21-year-old Hindu woman to convert to Islam. Though the marriage took place on November 17-18 as per the FIR lodged in the case, almost a week before the ordinance came into force, the police went ahead and booked them under its provisions. Since the ordinance came into force in November last year, the Uttar Pradesh police has filed 16 First Information Reports (FIRs), under which 86 people have been booked, including two minor girls and women, who according to the police were allegedly involved in ‘forcing’ Hindu women to convert to Islam.

Muslim men let go after ‘love jihad’ accusations found to be false

Date: 8 January 2021

Category: Discrimation

A month after booking two Muslim daily-wage workers in Muzaffarnagar under the anti-conversion law, the Uttar Pradesh government on 7 January told the Allahabad High Court that no evidence has been found against them under the new law, although one of them faces less serious charges such as criminal intimidation. The case against Nadeem (28) and Salman (29) was lodged at Mansoorpur Police Station on November 29, a day after the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Ordinance, 2020, came into effect. In his complaint to police, Akshay Kumar, who works as a labour contractor at a firm in Uttarakhand, alleged that Nadeem used to visit his house, and that he trapped his wife in a relationship and tried to convert her to Islam. He alleged that Nadeem wanted to marry her after converting her and Salman was helping him. Akshay also alleged that both threatened him when he objected to it. During investigation, it was found that Nadeem did not have any illicit relationship with the woman, the affidavit said, adding that her statement had also been recorded. However, it was found that he had threatened the complainant, it said, adding that a chargesheet was filed against him accordingly.

BJP will bring love jihad, cow slaughter laws in West Bengal, says MP Home Minister

Date: 8 January 2021

Category: Discrimination

Days after two petitions challenging the 'love jihad’ or anti-conversion laws were presented before the Supreme Court, Madhya Pradesh Home Minister Narottam Mishra vowed on 8 January that the Bharatiya Janata Party (BJP) will bring the law in West Bengal if it comes to power. Amid cow smuggling cases in the State, he also assured that the BJP government will also bring laws to protect cows. Mishra said, “It is unfortunate that innocent Hindu girls were lured and converted through love jihad. Also, Bengal is notorious for being a hub for cattle smuggling along the Indo-Bangladesh border. If BJP comes to power, we are certainly going to bring two laws against love jihad and cattle smuggling.”

Category: Hate speech

Ahead of the municipal elections in Hyderabad, BJP Telangana state president and Member of Parliament Bandi Sanjay calledfor a surgical strike in the Old City area of Hyderabad, which has a high Muslim population.  The BJP leader was speaking at a political roadshow, while campaigning for the GHMC (Greater Hyderabad Municipal Corporation) elections. Speaking at the roadshow, he said, "Once a BJP candidate wins the Mayor post in these elections, there will be a surgical strike on patha basti (Old City). It’s the BJP’s responsibility to kick out these Rohingyas and filthy sons of Pakistan." The “surgical strike” remark by Bandi Sanjay was received by his party workers with loud cheers and applause. Bandi Sanjay went on to say, "Elections must happen without Rohingya and Pakistani peoples’ votes, without Afghanistani voters. For such elections to happen in Bhagyanagar, it is only possible through the BJP. Those who win through minority appeasement and Muslim votes are called secular. When BJP comes forward for 80% Hindus, to protect the sentiments of Hindus, BJP is called a religious party. Yes, BJP works for Hindu dharma.”

Old video of Muslim MLA clipped to suggest he said ‘Pakistan Zindabad’

Date: 15 October 2019

Category: Hate speech

A 20-second video clip of Congress MLA Naseem Khan, in which he is heard saying ‘Pakistan Zindabad’ and then challenging the Prime Minister and Home Minister to ‘slap sedition charges’ went viral on social media, shared by handles including BJP leader Sambit Patra. However, a fact check revealed that the video was edited, and the MLA was actually speaking about an incident where Hindu spiritual leader Sri Sri Ravishankar had raised the slogan. Naseem Khan was referring to Sri Sri Ravishankar and the ‘World Culture Festival’, the mega event organised by him in Delhi in 2016. At the event, Ravishankar had said that ‘Pakistan Zindabad’ should go hand-in-hand with ‘Jai Hind’, a statement which had caused some controversy. Khan was actually challenging Singh and Modi to slap charges against Ravishankar.

BJP’s Sambit Patra falsely claims AAP leader wants to create ‘Sharia’

Ahead of Delhi assembly elections, a video of AAP leader Amanathullah Khan was shared by BJP spokesperson Sambit Patra with the caption “Allah has decided that oppressors will cease to exist..will make Sharia…it will start from somewhere” -AAP’s Amanatullah Khan. Friends, these are AAP’s thoughts, you also think about it. Will Allah decide everything or you too will decide? Do you want to make Sharia or not??” His tweet was picked up and shared by thousands of handles, including other BJP leaders such as Kapil Sharma. However, a closer analysis of the video proved that Khan had “zaria” (medium) and not sharia.

Former vice president targeted over remarks on Muslim condition

Date: 13 August 2017

Category: Hate speech

After former vice president Hamid Ansari commented that there was ‘a sense of unease’ among Muslims in India, a targeted campaign was unleashed online against him under the initiative of BJP spokesperson Sambit Patra, questioning his patriotism. Patra shared a graphic with news reports on the former VP’s absence from the Yoga Day parade and failure to salute the tricolour during Republic Day. As protocol dictates, the vice president is not supposed to salute when the president attends an event as the principal dignitary. This is why Ansari did not salute when former president Pranab Mukherjee was the principal dignitary at the Republic Day parade. Furthermore, the article on Yoga Day shared by Patra pertained to a 2015 controversy ignited by BJP national general secretary Ram Madhav. Ansari had not attended Yoga Day celebrations as he wasn’t invited. Huffington Post reported that union minister Shripad Naik cited protocol which states that the vice president cannot be invited to an event where the prime minister is the chief guest. Madhav had to later apologise for his tweet.

Sambit Patra falsely claims Muslim journalist wants an ‘Islamic Caliphate’

Date: 26 January 2020

Category: Hate speech

BJP spokesperson Sambit Patra tweeted a video of The Wire journalist Arfa Khanum with the claim that she had revealed the strategy to develop an Islamic caliphate. “Hindus will be required only till the time an Islamic society is not created,” he claimed she said. The part of her speech that was clipped starts from 17:15 minutes in the video. However, this portion, even when heard independently, does not translate to Khanum promoting the establishment of an ‘Islamic Caliphate/ society’. “This protest is also taking us to a society where everybody will be included. So we aren’t compromising our ideology, I want to reiterate this. We are not compromising out ideology but changing our strategy,” she stated. Here, the word ‘strategy’ implies adhering to a form of protest where religious slogans are shunned and a secular movement is embraced.

Video circulated to falsely claim Muslims in Kerala disrespected and burnt posters of Hindu deities

Date: 9 January 2020

Category:  Hate speech

On January 2, several social media users shared a video and claimed that anti-Citizenship Amendment Act (CAA) protesters burned pictures of Hindu gods during a rally. BJP spokesperson Sambit Patra quote-tweeted one of the tweets that had shared the clip and wrote, “This video is shocking …how can any protest have a right to defile the tenets of Hinduism ..who gives them the right to burn the pictures of Hindu Gods & Goddesses ..why should any protest be an Anti-Hindu protest?? Is this is what the Congress & Communists promote?? #Shame“ The clip was also circulated with the claim that this took place in Kerala. It alleged that the Muslim community in the state threw shoes at posters of Hindu deities, then burned them. However, the video in question was at least as old as August 2018. If one carefully listens to the audio, at the 58-second mark in the video shared by Satya Bhat Suda, one can hear the protestors chant, “Zindabad, Zindabad! Ambedkar Zindabad!” Alt News, which carried out the fact check, couldn’t verify the exact nature of the protest. However, it was clearly not linked with CAA protests. The claim made in social media that the viral video shows CAA protestors were burning posters of Hindu deities was false.

CAtegory: Hate speech

After Kerala minister G Sudhakaran criticized Hindu religion, BJP leader B Gopalakrishnan asked him to get circumcised, convert to Islam and move to Pakistan. Claiming in a Facebook post that his words had offended Hindus and Hinduism, Gopalakrishnan commented that he should become ‘cap-wearing Sudhakaran’. “Hindu religion gives him the freedom to criticize Hinduism. If it had been any other religion, his hands would be chopped off or his moustache would be pulled out. And these are the people he is calling ‘peace-loving mullahs’”. He also claimed that Sudhakaran was happily waiting for the day the Muslims would become a majority in India and Hindus would become a minority. According to Gopalakrishnan, that year is 2035. “Don’t wait for 2035. It is better you move to Muslim-majority countries like Pakistan before that,” the post said.

NewsNation’s Deepak Chaurasia hosts show on ‘Conversion Jihad’

Date: 9 November 2020

Category: Hate speech

News Nation television channel’s Consulting Editor Deepak Chaurasia was once again accused of peddling communal hate, this time on social media, through a show called “Conversion Jihad”. A clip of approximately 5 minutes was posted on Twitter on November 6, 2020 with around 12,000 views and close to 2,150 likes where he asked his audience/followers to tweet on Dharamantar Jihad (Conversion Jihad). Claiming that Hindus were no longer safe in ‘Hindustan’, he quoted the example of one Memchand who was allegedly forced to convert his religion, consume cow meat and threatened by some people.  He claimed to have revealed the plight of Hindus living in Mewat, Rajasthan who are being forced to convert their religion by the Tabhligi Jamaat members. He asserts that people born in a particular religion cannot be forced to convert by people belonging to other communities and that it is time to stand together against this injustice, insinuating that Hindus are subject to grave pressure by Muslims to convert. Throughout the show one can see captions like “Memchand Zinda hai…Jamaat Sharminda hai” (Memchand is alive and Tabhligi Jamaat members are ashamed) hinting at a concocted story with no reliable source. The show on its channel News Nation openly declared that 5000 Hindus have already become Muslims (5000 Hindu kaise banaye Muslim?) and captions like ‘Maulana Gang exposed’, ‘Mewat kya Pakistan ban gaya?’ (Has Mewat become Pakistan?). He also quoted Sadhvi Prachi, a Hindu political activist and member of Hindu Vishwa Parishad on twitter posting, “Love jihad ki janni hai Quran, apni bachiyo ko Gita padhao, Ramayan padhao, aathvi class mein Quran padhao, taaki bachiya apni Raksha karr sake” (Quran is the source of Love Jihad, read Gita and Ramayan to your daughters, read Quran to 8th graders so that they can protect themselves).

Telengana BJP leader threatens to burn theatres if movie  shows Adivasi leader in Muslim attire

Date: 3 November 2020

Category: Hate speech

Telangana’s Bharatiya Janata Party (BJP) President and Karimnagar MP Bandi Sanjay Kumar on November 2 threatened to burn down any movie theatre that screened Roudram Ranam Rudhiram (RRR) movie for portraying a respected tribal leader in traditional Muslim attire. Kumar accused Director S. S. Rajamouli of distorting historical facts by adding in a scene wherein Komaram Bheem, played by Jr. NTR, is seen applying surma, wearing an amulet and donning a Muslim skull cap. Historically, Komaram Bheem had led a tribal rights movement against the Nizams. Some members of the Gond community, to which he belongs, had also questioned this portrayal. However, filmmaker SS Rajamouli has already clarified that the story is fictional and not about patriotism. BJP MP and Adivasi leader Soyam Bapu Rao also threatened to arson cinema halls if the filmmaker portrays Bheem as a Muslim in the film.

Fact finding report on anti-Muslim violence in Madhya Pradesh reveals chilling details

Date: 8 January 2021

Category: Hate violence

A Muslim family’s house was looted, a toddler was attacked and the eyes of goats were gouged out by the mob who were part of a rally to fetch funds for the construction of the Ram Temple in Ayodhya on December 29 at the village of Chandan Khedi in Indore. The spine-chilling revelations form part of a seven-page report by a fact-finding team comprising social activist and Narmada Bachao Andolan convenor Medha Patkar, Supreme Court advocate Ehtesham Hashmi, socialist leader Rambabu Aggarwal and others from Indore. The team had visited Chandan Khedi village in Depalpur tehsil (about 60 kms from Indore) on January 6. It was the site where a communal clash had broken out on December 29 during a fund collection rally for the Ram Temple. “The participants of the rally were not only carrying swords, rods and sticks, but also carrying kerosene and diesel with them,” the report said.  The villagers had locked themselves in their homes when the rally entered the village. The mob hurled abuse at the locals and shouted provocative slogans but no one retaliated, the report revealed. The seven-page report brushed aside the Madhya Pradesh police’s claim that the clash broke out over an argument about a video being filmed. “The clash broke out after three youths climbed atop the minaret of the Eidgah, located at the outskirts of the village, and began vandalising it with the swords they were carrying. When locals retaliated, the stone pelting started from both sides,” the report said. It added that instead of taking strict action against the organisers of the rally or those who climbed atop the minaret, the police booked 23 residents for rioting, carrying deadly weapons and hurting religious sentiments under sections 147, 148, 298 and 323 of the Indian Penal Code; half a dozen of them are still in jail. The stone-pelting incident created chaos in the area and the mob disappeared. Minutes later, however, a mob of double its size attacked the homes of Kadir Patel and Akbar Patel on the outskirts of the village. “Three tractors, one jeep, two bikes, fans, TV, and a water pump owned by Kadir Patel were set on fire by the mob. The mob also attacked a toddler who was trapped in a room after the house was set on fire,” the report said, quoting Mukesh Chouhan, the patwari of the village. “The mob did not spare even animals. They beat a buffalo until its leg was broken and gouged out the eyes of goats,” the report said.  Five of Kadir’s sons were injured in the attack. While one received bullet wounds in his leg, another received a deep cut to his right hand from a sword. Three others were so brutally assaulted that they could be unable to work for a year. One of Kadir’s sons dialed the fire brigade after the mob set their home on fire. However, the mob blocked the road leading to his house. While all of this was happening, the police became mute spectators, the report said. The mob subsequently looted jewellery and lakhs of rupees in cash and fled the place. On the demolition of 13 Muslim homes the day after the incident, the report said: “Few homes were constructed under Pradhan Mantri Awas Yojana and yet the Indore administration demolished citing it encroachment on Government land without giving any prior information or notice.”

Category: Hate speech

RSS leader Kalladka Prabhakar Bhat stirred a fresh controversy after a video of him comparing Ullal in Mangaluru to Pakistan emerged online. Kalladka Prabhakar Bhat was speaking at an event in Kinya village in Dakshina Kannada when he said, "Hindus have reduced in and around Kinya. I don't have to speak about Ullal. So then who will protect our temples and who will protect our traditions? Why was there a Pakistan? Our numbers reduced and their numbers increased and that is why we got Pakistan and Bangladesh. If you go to Ullal pete (pete means town), isn't it Pakistan? Is it any different? Near home itself, a Pakistan has been built." Ullal is a locality in southern Mangaluru where a large number of Muslim families reside. The 2011 census data suggests that 56.1% residents are Muslim while 34.8% residents are Hindus in the area. This is not the first time Kalladka Prabhakar Bhat has made controversial statements. In December 2019, students in a school managed by Kalladka Prabhakar Bhat were made to enact the demolition of the Babri Masjid. The video of the enactment was shared on social media following which Dakshina Kannada police booked Kalladka Prabhakar Bhat.

Members of right-wing group Hindu Sena defaced the signboard of the India Islamic Cultural Centre in Delhi, by sticking posters that read “Jihadi Islamic Terrorist Centre” on it. The group’s president Vishnu Gupta confirmed it to news website The Quint. The group said it was angry at the Muslim community for their “terrorist activities” in France and elsewhere in India. The posters were later removed, according to the station house officer of Lodhi Colony. Gupta claimed that the “Islamic Cultural Centre is not Indian culture”.

Date: 27 October 2020

Category: Discrimination, hate speech

After intense backlash for alleged Islamophobia, a section of social media rallied in support of France following a series of controversial comments by its President Emmanuel Macron. From proposing stricter laws to uphold the principle of secularism to using terms like "Islamic separatism" and Islamic terror attacks", Macron's comments had evoked severe backlash from a host of countries, including Pakistan, Turkey and Iran. As the discourse seeped to the general populace on social media, many accused France of using secularism to persecute Muslim minorities in France and #BoycottFrenchProducts trended on Twitter. But soon, a new hashtag was trending on Twitter in India - #IStandWithFrance. Thousands of Indians accounts tweeted under the hashtag, expressing their support for Macron's decision to take a stand against extremism. Critics have, nevertheless, slammed Macron for targeting Muslims and using the violence for political advantage.

‘No Muslims, no pets’, says ad for flat in Mumbai

Date: 26 October 2020

Category: Discrimination

In an alleged case of Islamophobia, a Facebook user listed a 3 BHK flat located in Mumbai on a Facebook page with a condition that the tenant should not be a Muslim or own pets. Mumbai resident Unmesh Patil posted these terms and conditions on the Facebook page of Flats Without Brokers in Mumbai, along with pictures of the flats. The post went viral on social media, triggering outrage with netizens dubbing the post as an example of ‘apartheid’. Journalist Rana Ayyub shared the controversial ad on Twitter and wrote, ”Muslims and Pets not allowed. This is one of the most-posh addresses in Mumbai, Bandra. This is 20th century India. Remind me we are not a communal nation, tell me this is not apartheid?” Further, she narrated her own experience of house-hunting in Mumbai and said, “I have been house hunting in Bandra the last three months. My name ‘Rana’ does not come across as a Muslim name for many owners. It is only when they read that my surname is ‘Shaikh,’ I get a call from my broker on behalf of the owner with the most obnoxious excuse”. The post also caught the attention of Pakistan President Dr Arif Alvi, who slammed the ad and said that only a decadent society, encouraged by the extremist and abhorrent philosophy of BJP Hindutva and RSS, can allow this to happen.

OpIndia falsely claims journalist who criticized Advani is Pakistani

Date: 8 October 2020

Category: Hate speech

“Scroll gives space to Pakistani author to blame India for tensions between the two countries,” claimed pro-Bharatiya Janata Party (BJP) propaganda website OpIndia in a piece from October 6, 2020. The author referred to in the article was Jawed Naqvi and OpIndia’s basis for claiming his Pakistani nationality was his association with Pakistan-based newspaper Dawn. Naqvi is the New Delhi correspondent for the English language daily. Scroll had republished Naqvi’s article in Dawn on former Indian External Affairs Minister Jaswant Singh. “What if Jaswant Singh had been allowed to achieve peace between India and Pakistan?” is the title of the report which speaks about the Agra Summit of July 2001 between ex-Indian Prime Minister Atal Bihari Vajpayee and former Pakistani President Pervez Musharraf. The article was published after Singh’s passing on September 27 where Naqvi argued that the ex-foreign minister’s draft pact between the South Asian nations, “torpedoed” by former Home Minister LK Advani, “could have saved India and Pakistan an endless need to procure military hardware at prohibitive costs to their poverty-stricken masses.” “But it’s only in the clown world that we live in that India is blamed for apparently not allowing a peace deal to go through,” wrote OpIndia further, “But a Pakistani journalist cannot be expected to concede such basic truths. Unable to accept such obvious facts, it is only to be expected that a Pakistani journalist would clutch at straws to absolve the military-political establishment of his own country.”

Muslim regiment that never existed blamed for refusing to fight war against Pakistan

Date: 10 October 2020

Category: Hate speech

Social media was brimming with claims that the Muslim regiment of the Indian Army had refused to fight in India’s 1965 war with Pakistan. Several users used the viral message to question the ‘loyalty’ of Muslim candidates to be appointed to the posts of IAS and IPS officers. The claim went viral on both Twitter and Facebook and was also being circulated in the form of a video. It was also the subject of a tweet by BJP’s national media panellist Yasshveer Raghav in October 2017. However, fact-checking website went through several lists of regiments published by sources such as ABP News, Jagran Josh and Times of India and found that there was never a Muslim regiment in the Indian Army. BBC News Hindi recently published a fact-check report on the viral claim. Major General (Retd.) Shashi Asthana was quoted as saying, “There was never any regiment in the army known as the Muslim Regiment. These regiments were either formed in the British period based on race and ethnicity or these were groups which functioned as a princely army, such as the Jammu and Kashmir Light Infantry Regiment. This regiment was an army of the princely state of Jammu and Kashmir.”

TV9 claims there is underground tunnel in Nizamuddin Markaz, offers no proof

Date: 2 May 2020

Category: Hate speech

To add to the growing number of attempts made by Indian media to villify the Tablighi Jamaa-  and by extension, the Muslim community- as sources of coronavirus, Hindi news channel TV9 came up with an ‘exclusive’ report claiming that there was a secret underground tunnel in Nizamuddin Markaz, where a congregation of Tablighi jamaat was held in March 2020.  “Maulana Saad’s secret underground tunnel discovered in Nizamuddin Markaz'' was the topic for the day. Maulana Saad is the head of the Nizamuddin Markaz faction of the Tablighi Jamaat. TV9 reported that a 200-metre underground tunnel connects the Nizamuddin Markaz complex to Saad’s room. The tunnel gives him access to the entire complex – Lal Mahal, Baglewali masjid and Ghalib road, the channel claimed. Correspondent Manish Jha reported that the tunnel is close to 500 metres from the Nizamuddin police station and could only be accessed by Saad, his sons and close associates. He said that he found out about the tunnel from people close to Saad. During the show, images of the tunnel were flashed which the anchors claimed were shot by TV9, yet the footage carried the words ‘सांकेतिक वीडियो’ meaning ‘representational video’ and the same was also repeated twice during the show. If the footage aired by the channel was representational, all that the viewers really know about this ‘tunnel’ is through an animated map. The broadcast carries no statements from either a member of Tablighi Jamaat, an official of the Nizamuddin Markaz or the police. TV9 used hyperbole to sow seeds of doubt without giving concrete evidence (or any evidence for that matter) on the existence of a tunnel. It said that Saad has transformed from ‘corona master’ to ‘criminal master’. What criminal activities were exactly carried out from this tunnel, the channel doesn't say. Fact-checking website AltNews also gave a detailed description of the Markaz complex to show that an underground tunnel could not be possible in the complex. It also pointed out that the channel had aired pictures of the Lucknow Markaz, and not just the Delhi one, during the report.
