Couple married for three years allege harassment by UP Police under ‘love jihad’ law

Date: 14 January 2021

Category: Discrimination, harrasment

The Allahabad High Court on 13 January restrained the UP Police from taking action against a married interfaith couple, alleging harassment ever since the invocation of the controversial ‘love jihad’ ordinance. A Division Bench of Justices Ritu Raj Awasthi and Saroj Yadav at Lucknow ordered that till the next date of listing, the petitioners shall not be harassed by the police on the basis of the impugned FIR. The couple married three years ago out of their own will and now has a one-year-old child.

Republic Bharat falsely accuses Muslim man of hiding illness details, lies that he died

Date: 14 April 2020

Category: Hate speech

During an April 8 broadcast, anchors of news channel Republic Bharat told viewers that eight family members associated with a Tablighi Jamaat member had tested positive for coronavirus in Madhya Pradesh’s Khargone. A correspondent blamed the man Noor Mohammad for spreading the infection to his family and claimed that Mohammad had visited Nizamuddin Markaz in Delhi after returning from a foreign trip. He subsequently came back to Khargone where he did not inform local authorities that he showed symptoms for COVID-19, and he further stated that Noor Mohammad had died on March 28. He also said that Mohammad’s mother passed away. “Jamaat is the root of coronavirus cases in Madhya Pradesh,” declared the channel correspondent adding, “Had Noor Mohammad informed on time, he would have perhaps been kept in isolation.” Words such as “shameless”, ‘badtameez (ill-mannered)’, ‘behudi (stupidity)’ and ‘besharam jamaati (shameless jamaati)’ continuously flashed on the screen during the broadcast. However, an investigation revealed that while Noor Mohammad had indeed visited Nizamuddin Markaz after a foreign trip (South Africa) and later returned to Khargone, he was not dead. Alt News spoke with Mohammad who informed that he and his wife returned to Khargone on March 21 and his entire family was examined by district health officials at their residence on March 24. None of the family members were admitted to the hospital at the time since they did not have a fever. On March 31, reports came pouring in about a cluster of cases from the Tablighi Jamaat event held last month. “I contacted the doctors again and told them that I’m coming down to the hospital with my wife,” said Mohammad. District Magistrate Gopal Chandra Dad also informed Alt News that Mohammad had visited the district hospital on March 31, after the news about Nizamuddin Markaz broke out. This is when the couple’s samples were collected and they were admitted to the hospital. “Their results came out on April 4. Noor Mohammad tested positive while his wife tested negative,” informed Mohammad’s nephew Yasir Pathan. On April 9, Mohammad’s nephew Pathan filed a complaint with Khargone police on Republic Bharat’s misreport that Mohammad had passed away due to the infection on March 28.

Collector withholds Gujarat man’s request to convert to Islam, petition filed

Date: 14 January 2021

Category: Discrimination

A 32-year-old Hindu man, seeking to convert to Islam, moved the Gujarat High Court to direct Bharuch district authorities to expedite the process as more than a year had passed since he had submitted an application for the same. Petitioner Jignesh Patel's lawyer MT Saiyad on 14 January said Bharuch's collector had withheld Mr Patel's application for more than a year, despite a sub-divisional magistrate's inquiry report filed in February 2020 giving a favourable opinion that he may be granted permission for conversion. The sub-divisional magistrate's report established that Jignesh Patel was not under pressure to convert, as mandated in the state's anti-conversion law, Mr Saiyad said. Permission from the district magistrate is mandated for religious conversion in Gujarat under its anti-conversion law.

Ali Abbas Zafar’s web series Tandav, which was released on Amazon Prime on 15 January, sparked a debate on Twitter. #Tandav was trending on the platform on the day of release, and while some praised the performance of the actors and offered comments on the script and other aspects, a section of users took the opportunity to post highly Islamophobic content on the series, based on the fact that the director was Muslim. ‘Director is M, most of the cast is M. But series name is #Tandav Protagonist is named as "Shiva" has "Trishul" in his hand. How they use every platform 2 promote der narrative by showing HinduGods in poor light & term is as "FOE" & influence youngsters,” wrote one user under the handle @SheetalPronamo, along with the hashtag #BoycottTandav. The same quote was used by other handles as well. “The OTT #Tandav is used by anti-national gang to glorify the JNU incident and to mock Hindu deities. Their agenda was to defame "Hindus", "Brahman", "Modi", "India".  Still, if you favour Secualrism in India, then you are not a true Indian for me,” wrote another user. “if people weren’t azad in India then Muslims weren’t getting the equal opportunities as Hindus. Look at Bollywood. Everyone has been treated equally so @aliabbaszafar please stop putting Hindus down. If you weren’t equal then won’t be getting to offer namaz… Try showcasing Molana as a culprit or so then we’ll understand. Do you think we don’t know how did you flip the laws/wordings/politics/JNU. You should’ve stick to your politics story unlike creating a real world problems,” another user tweeted.

Old video of Maulana telling people to spit circulated amid Covid-19 outbreak

Date: 18 April 2020

Category: Hate speech

In an April 11 broadcast, India TV claimed that the efforts of the government were being derailed because of the weakest link i.e., Tablighi Jamaat. “There is another big accusation against the Jamaat – of spitting. Where did they catch the disease of spitting? Which Mulana gave them the symptoms of the virus, India TV has investigated,” said the anchor during the show. The channel subsequently played a video of an Islamic preacher saying – “To save yourself from the clutches of demons, read the Surah Al-Ikhlas and spit thrice on the left-hand side” – and paused before he was finished. “If you do not believe what you saw and heard, watch again and hear with your ears wide open so that no confusion is left.” The video is played for a second time and the anchor goes on the ask questions such as “Why do Jamaatis spit?” He further says that there have been reports of Jamaatis spitting on doctors and nurses in isolation wards. The anchor introduces the preacher as Faiz Syed and asks, “Does religion teach to spit on doctors and nurses?” However, the video played by India TV was three years old. It was shared by the YouTube channel IRC TV on October 25, 2017. Faiz Syed is an Islamic preacher and the founder of Islamic Research Centre (IRC). Syed refers to a hadith which talks about warding off evil thoughts (Shaitan) during prayers. The book ‘Waswasah: The Whispering of the Shaitan’ says that the Prophet was once asked by his companion: “O Messenger of Allah, Satan intervenes between me and my prayer and he confounds me,” to which the Prophet replied, “That is the doing of the Satan who is known as khinzab; when you perceive its effect, seek refuge with Allah from it, and spit three times to your left.” IndiaTV deleted the broadcast after a fact-check on the report was published.

TikTok video shared as Muslim men interrupting Durga Puja celebrations

Date: 21 October 2020

Category: Hate speech

A 32-second video went viral with the claim that ‘Jihadis’ had gone inside a Durga Puja pandal in Mumbai and interrupted the festivities. In the video, a man wearing a blue shirt enters the pandal along with another man and asks people to stop the music. Later, the same man can be heard saying, “If you want to live in the colony, you will have to chant Aslam Bhai Aslam Bhai. Modiji won’t come here, only Aslam Bhai will.” Many tweets claimed that the incident had taken place in Malad West Assembly Constituency in Mumbai, which is represented by Congress MLA Aslam Shaikh. On October 11, BBC Hindi published a fact-check report stating that the man in blue shirt is Ashish Singh. As per his Facebook profile, Singh is the owner of Kings Fitness gym and the vice president of Yuva Ekta Samajik Sanstha. Alt News contacted Ashish Singh to know the details of what exactly transpired. “I was jokingly creating a video similar to Tik-Tok clips. On that day around 1 PM, my friends and I were sitting together and discussing the elections. This was ahead of Maharashtra assembly elections. We were speculating that Aslam Shaikh is destined to win the elections. We made the video to have fun. But the clip was picked up on social media and shared with the claim that Durga Puja festivities were interrupted for Azaan. The video was falsely linked to Aslam Shaikh and shared online ahead of Maharashtra polls. However, the claim isn’t true at all. The video was given a Hindu-Muslim narrative. We had registered a complaint against social media misinformation,” he said. The same video was shared in 2019 with the claim that members of the Muslim community interrupted Durga Puja celebrations. Media outlets like News Nation, Swarajya (now deleted), OpIndia, and InKhabar passed it off with this claim. Postcard News founder Mahesh Vikram Hegde also promoted the claim in 2019.

Images from web series posted as RSS worker beaten up at Muslim wedding

Date: 10 September 2020

Category: Hate speech

Several Twitter and Facebook users juxtaposed two images of a man, one of which shows him badly wounded. The text on the image read, “This is mr. Chandraboss (RSS karyavahak). He was beaten to a pulp just because he attended a Muslim marriage. This happened in God’s own country Kerala.” However, the images turned out to be from an episode released by Malayalam web content maker ‘Karikku’. The actor who played the role had himself posted the images as part of promotion. The social media claim that the viral image showed an RSS worker who was beaten up for attending a Muslim wedding turned out to be false.

Organizations under fake Christian names circulate anti-Muslim content

Date: 15 January 2021

Category: Hate speech

The Kerala Council of Churches declared that a slew of anti-Muslim content being circulated online under the names of Christian organizations had no relation to the church and were fake. The circulars, which were released under the names of organizations such as Kerala Inter-Church Laity Council, mention topics such as ban on azans and halal meat and ‘love jihad’. The Council of Churches added that they had filed a case with the cyber cell to catch the mischief makers. The Laity Council itself had earlier released a statement declaring that it had not asked for a ban on halal meat.

OpIndia gives false spin to Tamil Nadu govt’s order to temples to donate Rs10 crore

Date: 19 May 2020

Category: Hate speech

On April 29, OpIndia published an article with the headline — ‘5,450 tonnes of free rice to 2,985 mosques, 47 temples have to pay rupees ₹10 crores: Tamil Nadu government order,’ giving the impression that temples in Tamil Nadu were directed to pay for free rice to be supplied to mosques. The phrase ‘Tamil Nadu government order’ suggests that a single order was issued in the matter. OpIndia’s article talks about two different circulars sent by the Tamil Nadu government’s Hindu Religious and Charitable Endowments Department (HRCE) to 47 temples on April 22. These controversial circulars essentially instructed the temples to donate ₹10 crores towards the Chief Minister’s Public Relief Fund (CMPRF) to aid those suffering from the effects of the coronavirus pandemic. The circulars do not mention anything about free rice to mosques. In its article, OpIndia also claims that “unlike Muslims, Hindus don’t get anything in festivals”. On May 2, right-wing propaganda website The Frustrated Indian published an article that said, “This effectively means that the Tamil Nadu government, of which the BJP is an ally, is snatching funds from Hindu temples in order to cover-up their costs of appeasing the Muslims.” The annual initiative to offer free rice to mosques during Ramzan was introduced by late Chief Minister J Jayalalithaa in her 2001 term, as per a report by The Outlook. The money does not come from donations by temples, but from the government exchequer.

Interfaith marriage alleged to be ‘love jihad’, girl busts claim

Date: 16 January 2021

A union minister continued to demand a law against ‘love jihad’ in Rajasthan quoting a case of an interfaith marriage where the girl’s family had alleged that it was for conversion through marriage, even though both police and the girl herself denied these claims. Union Minister of State for Agriculture Kailash Chaudhary demanded the law in the state despite the girl in a video statement on social media and to the police asserting that she married on her own accord and police too rejecting the allegation. Bikaner resident Manish Dudi, 18, married 22-year-old Mukhtiyar Khan in December 2020 after a brief love affair, prompting the woman’s family to issue a statement on social media terming the alliance to be a case of “love jihad”. While the woman’s father, in his video statement, sought the community’s help in the matter, her grandfather threatened that he would commit suicide with the entire family if no justice was done to them. The video statement by her family led the woman to issue a statement, asserting that she married the man on her own will on December 10 last year and instead of her converting to the Islam, the man himself has converted to Hinduism. The Bikaner police said it was not a case of “love Jihad” and they married as per their own free will. “Such incidents are not good for social harmony. A law against love jihad should be enacted on the lines of Uttar Pradesh. The Bharatiya Janata Party stands with Bikaner’s family and assures them that the BJP will enact a strong law in Rajasthan to prevent such incidents on coming to power ib state in future,” the minister tweeted.

Forced demolition leaves more than 500 Muslims homeless in Assam’s Bharasingri

Date: 20 October 2020

Category: Hate violence

On 20 October, the administration of Assam’s Sonitpur district demolished the houses of 64 Muslim families in Bharasingri village, rendering more than 500 people homeless amid the COVID-19 pandemic. Residents of Bharasingri said that Assam police, as well as various paramilitaries and the administration entered the village, evicted them from their homes and used JCBs to level their houses. The demolition was preceded by a campaign by the Bharatiya Janata Party accusing the villagers of being “illegal Bangladeshis,” despite all of them featuring in the National Register of Citizens. Many locals said that the district administration was working at the behest of BJP leaders in demonising Muslims and carrying out demolitions on their behalf. Government representatives told us this was a legal eviction of those who were squatting on government land, but The Caravan could access multiple land deeds that show that the land legally belonged to Muslim locals. Locals also said that the administration did not follow any of the legal processes that have to be undertaken before a demolition. Earlier in August, after the foundation stone for the Ram temple had been laid by the Prime Minister, an attempt to create communal toruble had taken place in the area. In a video obtained by The Caravan, BJP MLA Ashok Singhal, who visited the area after the violence, could be heard saying “If Babur bhakts”—followers of Babur, the 13 century Mughal emperor, a pejorative reference to Muslims—“attacked Ram bhakts, a befitting reply will be given.” Another BJP MLA Padma Hazarika claimed that similar evictions had been carried out in several districts. “It is on the prime agenda of our government that if any doubtful citizen has encroached government land then they should be evicted,” Hazarika told The Caravan reporter. “Eviction has been carried out in Kaziranga, Chokighat, Mangaldai, Morigaon similarly eviction has been done at Thelamara. As they do not have any legal document, they have grabbed the land illegally hence the government has executed its duty.” When told that nearly all the residents of Bharasingri had citizenship and land documents, Hazarika said that it was not his responsibility to scrutinise the documents. “Whatever people say, we have nothing to answer against them. The government can say who is illegal after proper investigation, I cannot do the investigation. They will submit their documents to the administration to probe, be it their citizenship or their land possession. The government will prove that.”

BJP MLA asks Muslims to sacrifice children instead of animals during Bakrid

Date: 29 July 2020

Category: Hate speech

The BJP MLA from Loni in Ghaziabad said that his supporters would not allow the sacrifice of animals in his constituency during the Muslim festival of Bakrid, and added that if someone has to give sacrifice then they should instead sacrifice their children. Nand Kishor Gurjar maintained that animal sacrifice was being stopped to “check the spread of coronavirus in the area”. “Humare log iska dhyan rakhenge ki Loni ke andar bilkul corona na aaye. Ishliye puri tarah qurbani di gayi toh (wey) jimmedar honge, aur hum hone nahi denge..” (We will ensure that there is no spread of coronavirus in Loni, and if animal sacrifice is performed then those people will be responsible and we will not allow that to happen).” He also said that in Hindu sanatan dharma there was a provision for “bali” or animal sacrifice earlier, which has now been done away with. “Just like in sanatan dharma, there was a provision earlier of bali, but now it has been replaced by breaking of a coconut. In a similar manner, it is my request to those following Islam to not sacrifice animals… Agar jyada koi kehta hai ki qurbani deni hai to apne bache ki de (If someone says they have to sacrifice animals, then they can sacrifice their own children),” Gurjar said.

Gujjar homes targeted and demolished in Jammu

Date: 19 July 2020

Category: Hate violence

On 18 July, the Finance and Forest Department demolished houses belonging to the Gujjar and Bakarwal community in Bandi area of Jammu district as a part of the demolition drive to root out people “living illegally”. The demolition drive came after an order by the Jammu and Kashmir High Court to remove the illegal occupation. The Jammu district administration demolished houses of people that it claimed were living illegally in areas like Sidra, Ragoda, Bandi Mohalla, and Lower Dwada. However, the demolition raised eyebrows, with people questioning the selective nature of demolition. One of the people whose house was demolished claimed that he had been living in the area for fifty years and the Forest and Revenue Department had “never objected” to it. “Now suddenly the administration has  demolished our houses, which makes it clear that special Class people are being targeted,” a local resident said. “Although other people in Jammu have taken possession of hundreds of Kanals of forest land, the forest department has not taken action against them,” said another local resident, Noor Mohammad, adding that Muslims are being targeted. Gujar leader Chowdari Nazakat Kathana told TwoCircles.net that over five residential houses were demolished in a short notice forcing the inhabitants to live under an open sky amid COVID-19 and scorching heat. Khatana says this was done on the instructions of BJP & RSS leaders, who don’t want to see any Muslim in the Jammu region. “Gujjar is just the name. Their targets are Muslims. They want entire Jammu to be Muslim free,” Khatana told TwoCircles.net. Khatana claimed that a local advocate has filed a petition both in the High Court and Supreme Court in the name of “Zamin Jihad” by Muslims. “A smear campaign was also launched against the Muslims of Jammu in different news channels,” he said.

Category: Hate violence

The Karnataka Police arrested journalist Imtiyaz Shah Tumbay in Dakshina Kannada district on September 7, five days after he reported on alleged police excesses during a raid on the house of a person accused of murder. Tumbay, 24, is the Bantwal taluk reporter of Vartha Bharati, a multi-edition Kannada newspaper published from Mangaluru, Shimoga and Bengaluru. In his report on the raid on the house of Kalandar Shafi – who stands accused of murdering a Rashtriya Swayamsevak Sangh worker in July, and is on the run – Tumbay reported that Shafi’s family alleged that the policemen had desecrated the Quran, the central religious text for Muslims. Along with Tumbay’s report, the newspaper published a photograph the family shared as evidence. The police took suo moto (on its own) cognisance against the report and booked Tumbay under sections of the Indian Penal Code pertaining to giving provocation with intent to cause a riot and statements creating or promoting enmity, hatred or ill-will between classes.
